Guest Rental Terms and Conditions
Payment of the Deposit constitutes acceptance of these terms and conditions by the Guest and acceptance of that payment binds the Owner. No Agreement exists until the Owner acknowledges receipt of the Deposit.
OWNER(s): The Directors of Llys Bennar Ltd (LBL). (Tony Osborne and Sarah Tucker of 2 Llys Bennar Ffordd Benar Dyffryn Ardudwy Gwynedd LL44 2RX).
GUEST(s): Those paying the deposit and the balance of the Holiday Rental Fee and adult occupiers (over 18) of the Property during the Holiday Rental Period. Whenever there is more than one Guest, each and every covenant and obligation can be enforced against all the Guests jointly and against each individually. At least one Guest must be 18 or over.
SITE: The holiday cottages and owners accommodation located at Llys Bennar Ffordd Benar Dyffryn Ardudwy Gwynedd LL44 2RX
PROPERTY: The holiday cottage you are booking within the Site
HOLIDAY RENTAL PERIOD: The dates you are booking the Property as per the booking confirmation you will receive. Check in and check out times vary between the Properties and are as advertised. Late departures will incur a charge/charges. If you leave the Property without removing all personal belongings the Owner reserves the right to enter and pack your belongings and remove them from the Property.
HOLIDAY RENTAL FEE: The total fee you are paying to stay at the Property.
DEPOSIT: A deposit of 20% of the Holiday Rental Fee must be paid in order to reserve your chosen Holiday Rental Period dates. Until this has been acknowledged your dates have not been reserved.
SECURITY DEPOSIT: The Owner reserves the right to charge a Security Deposit to be paid with the balance of the Holiday Rental Fee. You will be notified if this is a requirement prior to your booking. This is repaid at the end of the Holiday Rental Period subject to the Guest having performed the Guest Covenants.
PAYMENT DATES: A deposit of 20% must be paid in order to reserve your chosen Holiday Rental Period dates. Until this has been acknowledged your dates have not been reserved. The balance of 80% must be paid no later than 4 weeks before the date of your arrival along with any Security Deposit (if required).
PAYMENT METHOD: Payment is to be made by Electronic Funds Transfer
CANCELLATION BY GUEST: If You cancel (for any reason) a cancellation charge is payable as per the table below.
- Time before arrival date that notification is received - Cancellation Charge as % of Holiday Rental Fee
- Within 14 days - 100% i.e. No refund is due
- Between 15 and 29 days - 50% retained by Owner
- 30 days and over - 0% i.e. Full refund paid to Guest
CANCELLATION BY OWNER
If the Property becomes unavailable or unusable for any reason prior to the start of the Holiday Rental Period, the Owner will contact you as soon as is reasonably practicable and if possible offer a suitable alternative Property. If an alternative Property is unavailable, you will be reimbursed any monies already paid by you by way of full and final settlement.
RIGHT TO REFUSE/TERMINATE BOOKINGS
The Owner reserves the right to refuse a Booking. The Property is located in a residential area and is not suitable for hen or stag parties or groups who wish to play music loudly. If the Owner consents to you bringing a pet then you must ensure that your pet is well behaved and does not impact the enjoyment of anyone else on Site.
The Owner reserves the right to terminate the Agreement without prejudice to any rights and remedies accrued by the Owner or the Guest which shall remain following termination. If there is a material breach of this Agreement the Owner may ask you to leave the Property immediately with no requirement to refund any part of the Holiday Rental Fee.
Guest Obligations. The Guest will comply with the Guest’s obligations:
Payments
To pay the Deposit, the balance of the Holiday Rental Fee and any other payments due on the Payment Dates using the Payment Method.
Security Deposit (if applicable)
The Guest will pay the Security Deposit (if charged) as security for their performance of the Guest’s obligations. This will be used to offset any compensation due to the Owner for any breach of these obligations. It is agreed that no interest shall be payable on this security deposit. The balance of the security deposit is to be paid by the Owner to the Guest who paid the Security Deposit or to another party at their request only after vacation of the
property, such amount to be assessed at the outgoing inspection at the end of the Holiday Rental Period.
Occupants
At least one Guest must be aged 18 or over.
Not to exceed the maximum number of people able to occupy each Property. Only the Guests (not to exceed the specified number) are to stay overnight at the Property and a Guest cannot assign or sublet or part with possession of the property, or let or allow any other person to stay at the Property. The maximum number of Guests aged over 2 for each property is as follows:

Care of the Property
Not to damage the Property or the Owner’s contents (whether fixtures e.g. kitchen units or fittings e.g. kitchen contents) nor cause damage to any part of the Site nor make any alteration or addition to it. To leave the Property secure when unoccupied i.e. the door should be locked. To immediately report to the Owner any damage whether caused by the Guest or not.
Right of Entry
To allow the Owner at reasonable times, on giving reasonable notice (unless in the case of emergency) to enter the property with others e.g. workmen if necessary for the purpose of repair or maintenance.
Use and Location of Property
To use the Property as a single, private holiday home and not to use it, or any part of it, for any other purpose, nor to allow anyone else to do so. To be considerate of neighbours and neighbouring land. We are surrounded by working farms so all pet waste must be picked up and disposed of appropriately. As we are in a rural location you may experience some animal noise and occasional noise from grass cutting/farm machinery. Not to receive paying guests. Only to bring appropriate vehicles and not to use more spaces than come with the Property:
- The Property enjoys parking for domestic vehicles.
- The number of spaces per Property is specified in the table above. If you require additional parking please contact the Owner in advance.
- The driveway to the property is perfectly accessible for domestic vehicles including 4 x 4’s, However, there is no suitable access or parking for large vans or caravans.
- The Owner is not responsible for any personal items you bring to the property and you should ensure that you have all necessary and appropriate insurance in place.
- The accommodation is self catering and your rental does not include the provision of any food or meals.
- Any breakages must be paid for but rest assured we don’t have any valuable works of art and any recompense will be reasonable. Not to do, or permit, or suffer to be done in or on the Property, any act or thing which may be a nuisance, damage or annoyance to the Owner, to other Guests on Site or to the occupiers of the neighbouring premises, or which may void any insurance of the Property.
- Not to glue, stick or otherwise fix anything whatsoever to the exterior or interior walls, doors, windows, floors or other surfaces of the property without the Owner's consent. To take all reasonable precautions to prevent damage by frost and fire. Not to introduce into the property any portable heaters fired by liquid or bottled gas or any other naked flame without the Owner's prior written consent.
- Our traditional cottages are believed to be over 200 years old. They have uneven floors, steep stairs and low beams – we are sorry but this does mean that the Property may not be suitable for everyone. Please bear this in mind before booking and feel free to e-mail us with queries or to arrange a call if you have specific questions.
Pets
You are welcome to bring well behaved dog(s). The number of dogs per Property is specified in the table above. Please be aware that the gardens are open and the Property does not enjoy secure garden areas. There will be other Guests and there could be other dogs on Site. Therefore you must ensure that dogs are properly controlled and supervised at all times. Dogs will not be allowed to remain on Site if they are causing distress to other Guests. You are advised to bring a pet bed, food bowls, extra towels and anything else your dog may require to enjoy their holiday. If your dog(s) want to accompany you in the bedroom please remove blankets and throws. Please protect the sofas with the dog towels we provide.
Allergies
Guests with allergies should be aware that the Owner cannot guarantee that there have been no dogs at the Property. Whilst the Properties are thoroughly cleaned the Owner cannot accept any liability for any suffering which may occur as a result of pets having been present. Guests should also be aware that welcome baskets are often provided by the Owners. These are likely to contain gluten, nuts and dairy products. Please do not use the food provided if you have allergies.
Requirements to Notify
To notify the Owner promptly of any disrepair, damage or defect in the Property, or of any event which causes damage to the Property, or which may give rise to a claim under the insurance of the Property, or of any breakdown of appliances. Failure to do so may result in the Guest being liable for any subsequent damage. If you have a complaint please notify the Owner promptly describing the nature of the complaint to allow for remedial action where the Owner deems such action possible and appropriate
Breaches of this Agreement
To pay and compensate the Owner fully for any costs, expense, loss or damage incurred or suffered by the Owner as a consequence of any breach of this Agreement and to indemnify the Owner from and against all actions, claims and liabilities in that respect. You agree to pay to the Owner any reasonable costs incurred in making good any such loss or damage.
Owner’s Obligations. The Owner will comply with the Owners Obligations:
Provided that the Guest shall pay the Holiday Rental Fee and perform the covenants on his part already referred to, the Owner shall permit the Guest to have quiet enjoyment of the property during the Term agreed without interruption by the Owner. The Owner will provide bedding for all beds. Bedding will not be provided for cots. Travel cots and highchairs are available on request. The Owner will provide one set of towels per guest. These towels are for use in the Property and Guests are requested to bring their own towels for use on the beach.
The Owner shall keep the property insured in the Owner's name for:
(a) loss or damage by fire, lightning, explosion, storm, flood, burst pipes, subsidence, riots or civil commotion, malicious damage and accidental damage, impact and such other risks (if any) as the Owner, at the Owner's sole discretion, may from time to time consider prudent or desirable including employer's and public liability or any other liabilities that are resulting from the Owner's ownership of the property.
(b) the Owner's contents BUT PLEASE NOTE THIS WILL EXCLUDE the Guests contents which remain the responsibility of the Guest. At the end of the Rental Holiday Period, the Owner will repay the security deposit (if charged) to the Guest without interest, after all sums due (if any) to the Owner under the terms of this Agreement, or following breach of any of its terms, have been deducted.
Liability
All warranties, conditions and other terms implied by statute or common law are to the extent permitted by law excluded from this Agreement. The Owner shall not be liable for any actual or alleged indirect or consequential loss howsoever arising including but not limited to any loss of profits, anticipated profits, savings, business opportunity, loss of publicity or loss of reputation or opportunity to enhance reputation or other economic loss. The aggregate liability of the Owner shall not exceed twice the total amount of the Holiday Rental Fee
received. The Owner cannot be responsible for building or road works which may be carried out close to your Property although where anticipated works are known the Owner will endeavour to advise you in advance of your arrival.
Force majeure
The Owner shall not be liable for any delay or non-performance of their obligations under the Contract to the extent that the performance is interrupted or prevented by any act or omission beyond its reasonable control. The Owner shall notify the Guest as soon as is reasonably practicable upon becoming aware of any factor which may initiate this clause.
Applicability of Law
If any term within this Agreement is found to be unenforceable then that term is deemed to be excluded from the Agreement but all remaining terms remain unaffected.
